Some of our recent legalisation projects include:
State Highway 2 Passing Opportunities Project – Matahorua Legalisation
Exchanging Railway land for State Highway under Section 17 the Public Works Act 1981. An adjustment of the common boundary between the Palmerston North – Gisborne Railway and State Highway 2 was required to ensure roading infrastructure was located within the legal road corridor.
Howard Street Legalisation
Earmarked as a Residential Growth Area under the Heretaunga Plains Urban Development Strategy (HPUDS), land between Hastings and Havelock North called for a Legalisation Survey to create a new road corridor. This was a complex project involving multiple stakeholders.
Waimapu River Marginal Strip Assessment
A Marginal Strip assessment was required for the Waimapu River alongside the Toi Ohomai Campus, Tauranga. This survey was required when the Crown, or in this case the Ministry of Education, transferred ownership of the land to Toi Ohomai. Part 4A of the Conservation Act 1987 required public access along river via a Marginal Strip.
Mangatahi Bridge Legalisation
This new low-level bridge was constructed in the Hastings District to replace an aging and flood-prone bridge. A Legalisation Survey was required to tidy-up the ownership of land surrounding the bridge and ensure the bridge was located within the legal road corridor.
State Highway 2 Passing Opportunities Project –Kotemaori Legalisation
A Legalisation Survey was required after the construction of a slow vehicle bay along State Highway 2. The road corridor was widened in to private land to aid the flow of traffic between Napier and Wairoa.
Removal of Limitations of Crown Land
Not dissimilar to a legalisation survey, a Removal of Limitations Survey may be required to support property dealings of Crown Land. This type of survey was required to better understand the boundaries and firm-up the extent of ownership of the Eastern Institute of Technology (EIT) Wairoa Campus.
Glenham Primary School Marginal Strip Assessment
A Marginal Strip assessment was required for a waterway traversing Glenham Primary School, Southland. This type of survey may be required when the Crown, or in this case the Ministry of Education, disposes of land no longer required for a public purpose under Part 4A of the Conservation Act 1987. Formalising the legality of the stream and ensuring public access via a Marginal Strip was required.
